Civil Process Division

The Civil Process Division serves civil processes issued by the court system.

One of the duties of Sheriff’s Offices across the state of North Carolina is serving court documents, which is also known as civil process. The Civil Process Division at the Buncombe County Sheriff’s Office serve documents such as summons, writs of possession, foreclosures, executions, claim and deliveries, subpoenas, restraining orders, child custody orders, show cause orders and child support warrants.

Procedure for obtaining service on an Out-of-State process

Paperwork Needed:

Original Summons (including attachments as necessary)

Original Return of Service Form

One copy for each person being served

Letter of instructions or special needs as desired

Self-addressed stamped envelope for return to the originating Clerk of Superior Court.

NOTE: Persons must reside within Buncombe County—physical address required; no post office box.

Buncombe County Detention Facility

The Detention Facility is made up of the main jail facility and a jail annex, which together have a total housing capacity of 604 inmates. Our facility requires 160 staff, working in shifts, to operate in full and to provide food and care for the inmates. We house an average of more than 500 inmates daily.

All individuals who are charged by local law enforcement agencies in Buncombe County are brought to the detention facility on a pre-trial basis, meaning they will wait for their court date(s) at our facility. Inmates are processed and released 24-hours a day upon instruction of the judicial system.

Captain Jeffrey Littrell is our Detention Facility Administrator. Captain Jeffrey Littrell along with six facility Lieutenants and 15 Sergeants help to maintain a standard of safety and cleanliness at the Buncombe County Detention Facility.

Court Security

Our Court Security division is responsible for the safety of the courthouse and all courtrooms, both civil and criminal.

Six District Courts and three Superior Courts are required to have a Court Bailiff, a sworn Deputy, who works as part of court system to maintain safety. Deputies also provide security screening upon entering the courthouse annex where the public must pass through metal detectors.

School Resource Officers

The Sheriff’s Office has SROs who are sworn deputies at 42 schools across Buncombe County. Our mission is mentoring and counseling kids. We hope to build strong relationships with our youth in order to deter them from using drugs and alcohol. We are acutely aware of the changing needs of our students and part of our training includes how to engage with students who have behavioral challenges. We work to build trust, so that they feel comfortable bringing issues of bullying or problems they might be experiencing at home to us. SROs have been trained to keep our schools safe by participating in active-shooter drills as well as holding CPR certification.
